- CPR Part 35 expert witness report: typically £3,000–£7,000, required once proceedings are contemplated.
- Mediation: £1,000–£3,000 shared – resolves the majority of cases that reach it.
- Full litigation to trial: £30,000–£100,000+ per side is common, and the loser usually pays a large share of the winner’s costs.
What drives costs up
Poor early evidence, emotional escalation, counterclaims (fences moved, hedges removed), and “principle”. Cases turn on evidence: title plans only show general boundaries, so historic mapping, photographs, physical features and expert measurement decide outcomes – the earlier that evidence is professionally assembled, the cheaper the dispute.
How to keep costs down
Commission an independent boundary dispute surveyor before instructing litigators; propose a jointly instructed expert to your neighbour (half the cost, twice the authority); use a boundary agreement registered with the Land Registry to fix the line permanently; and treat mediation as strength, not weakness. Understand the rules on boundary walls and fences before assuming a trespass.
